12 THE CITY OF ~~ ' IM MI ~b 1 L~E~S~4NTONo CITY COUNCIL AGENDA REPORT November 6, 2007 Police Department TITLE: RESOLUTION AUTHORIZING THE APPLICATION OF THE CALIFORNIA VEHICLE CODE TO ROADS WITHIN RUBY HILL SUMMARY The Ruby Hill Homeowners' Association (HOA) and the Pleasanton Police Department consistently receive from Ruby Hill residents complaints regarding speeding, unsafe driving, traffic safety and failure to obey traffic signs in Ruby Hill. The roads within Ruby Hill are privately owned and maintained by the HOA, and within the development the Police Department currently does not have authority to enforce most provisions of the California Vehicle Code. The Vehicle Code, however, provides that a homeowners' association may petition a City Council to adopt a resolution that authorizes the application of the Vehicle Code to private roads in the development. The HOA has adopted the attached petition that makes such a request. To address the public safety concerns voiced by the HOA and residents, staff recommends that the City Council approve the attached resolution authorizing the application of the Vehicle Code within Ruby Hill. Notices of this hearing have been mailed to the HOA and all property owners in Ruby Hill. RECOMMENDATION Approve the resolution authorizing the application of the California Vehicle Code to the roads within Ruby Hill. (Attachment 1) FINANCIAL STATEMENT The fiscal impact to the City should be minimal. No additional Police Department personnel or other City staff are likely needed to enforce traffic laws within Ruby Hill. The HOA will pay for all expenses associated with noticing all hearings regarding the application of the California Vehicle Code to roads within Ruby Hill and for purchasing, installing, owning, maintaining and replacing all traffic signs, signals, markings, and devices, as well paying for as any related traffic studies required by the Director of Public Works.
