12 <br />THE CITY OF <br />~~ ' IM MI ~b 1 <br />L~E~S~4NTONo CITY COUNCIL AGENDA REPORT <br />November 6, 2007 <br />Police Department <br />TITLE: RESOLUTION AUTHORIZING THE APPLICATION OF THE CALIFORNIA <br />VEHICLE CODE TO ROADS WITHIN RUBY HILL <br />SUMMARY <br />The Ruby Hill Homeowners' Association (HOA) and the Pleasanton Police Department <br />consistently receive from Ruby Hill residents complaints regarding speeding, unsafe <br />driving, traffic safety and failure to obey traffic signs in Ruby Hill. The roads within Ruby <br />Hill are privately owned and maintained by the HOA, and within the development the <br />Police Department currently does not have authority to enforce most provisions of the <br />California Vehicle Code. The Vehicle Code, however, provides that a homeowners' <br />association may petition a City Council to adopt a resolution that authorizes the <br />application of the Vehicle Code to private roads in the development. The HOA has <br />adopted the attached petition that makes such a request. To address the public safety <br />concerns voiced by the HOA and residents, staff recommends that the City Council <br />approve the attached resolution authorizing the application of the Vehicle Code within <br />Ruby Hill. <br />Notices of this hearing have been mailed to the HOA and all property owners in Ruby <br />Hill. <br />RECOMMENDATION <br />Approve the resolution authorizing the application of the California Vehicle Code to the <br />roads within Ruby Hill. (Attachment 1) <br />FINANCIAL STATEMENT <br />The fiscal impact to the City should be minimal. No additional Police Department <br />personnel or other City staff are likely needed to enforce traffic laws within Ruby Hill. <br />The HOA will pay for all expenses associated with noticing all hearings regarding the <br />application of the California Vehicle Code to roads within Ruby Hill and for purchasing, <br />installing, owning, maintaining and replacing all traffic signs, signals, markings, and <br />devices, as well paying for as any related traffic studies required by the Director of <br />Public Works. <br />
