defined in the Design Guidelines. Th+s These changes shall <br />be shown on the tentative subdivision map to the satisfaction of the Planning <br />Director. <br />Air Quality <br />~9. To address the potential impacts on sensitive receptors to pollutant <br />concentrations resulting from grading, a dust control plan or procedure shall be <br />submitted by the project developer with the subdivision's improvement plans <br />before recordation of the final subdivision map er and by the lot owner/contractor <br />with the grading plans for the individual home sites. The dust control plan shalt <br />include the applicable conditions of this approval, the appropriate dust control <br />measures of the Bay Area Air Quality Management District (BAAQMD), and shall <br />be subject to the review and approval by the Planning Director and the City <br />Engineer. These conditions and measures shall be reflected in the construction <br />contracts issued for the grading and site preparation. A modified form of this <br />statement shall appear in the design guidelines. (Mitigation Measure C-1 of the <br />FEIR.) <br />Biological Mitigation Measures <br />X10. The project developer shall retain qualified biologists to prepare and submit the <br />following biological reports/analyses and/or plans before the first final subdivision <br />map application for review and approval by the Planning Director and by the <br />United States Fish and Wildlife Service (USFWS), prior to the City Council's <br />action on the first final subdivision map: <br />a. To address the potential significant impact on California tiger salamander <br />populations due to the disturbance or removal of their upland or dispersal <br />habitat area, a California Tiger Salamander (CTS) Mitigation and Monitoring <br />Plan shall be prepared in consultation with the USFWS. (Mitigation <br />Measure D-1 of the FEIR.) <br />b. To address the possible significant impact on California red-legged frog <br />species due to disturbance or removal of upland or dispersal habitat, a <br />California Red-Legged Frog (CLRF) Mitigation and Monitoring Plan shall be <br />prepared in consultation with the USFWS. (Mitigation Measure D-2 of the <br />FEIR.) <br />c. Based on the surveys conducted on the site to date, it has been determined <br />that the project site contains Viola pedunculata, the larval host plant for the <br />callippe silverspot butterfly (Speyeria callippe callippe) and other subspecies <br />of the species Speyeria callippe, and that butterflies which need this plant for <br />part of their life cycles may occur on various portions of the project site. <br />Based on these initial observations, it may be that Speyeria callippe callippe <br />occurs on the site, but due to the similarities between Speyeria callippe <br />callippe and other subspecies or hybrids, a positive identification has not <br />City Council October 2. 2007 Page 3 of 41 <br />
