2. Property subject to agreement. The property which is the subject of this Agreement is described in Exhibit "A". 3. Landscaping Plan. Reference is made to the Planning Com- mission proceedings of January 18 1981 and the landscaping plan which, by Condition 23 of the P.U.D. Development Plan approval is ~~ (has been) approved by the Planning Department. Landscaping as a benefit. Property owner agrees that the landscaping which it is obligated to provide will materially benefit. ~„tg.property and it is necessary to comply with the P.U.D. Develop- ment Plan approval conditions imposed by the City as a require- ment of the development of the property, as shown in Resolution 1936 incorporated by reference herein and attached hereto as Exhibit "B". 5. Duty to maintain landscaping. Property owner agrees to diligently maintain and care for the landscaping which it installs, using generally accepted methods for cultivation .and watering. Pro- perty owner shall maintain that standard of care necessary to prevent the landscaping from deteriorating to the extent that its value as landscaping is destroyed. 6. City may maintain landscaping. Property owner agrees that if he fails to meet the standard of maintenance necessary to keep the landscaping in a healthy condition, the City may elect to take the steps necessary to assure that the landscaping is maintained and cared for.
