<br />RESOLUTION N0. 1011 RE: BESCO, INC. (Val Vista Tract)
<br />A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
<br />PLEASANTON, AUTHORIZING THE ZONING ADMINISTRATOR TO GRANT
<br />CERTAIN VARIANCES WITH RESPECT TO LOTS 29, 30, 31, 32, 41,
<br />42, 43, 52, 53, 54, 63, 64, 65, 74, 75, 76, 85, 86 & 87
<br />WHEREAS, the City of Pleasanton, as part of the installation of
<br />the West Pleasanton Sewer, seeks to acquire from, among
<br />others, Qualified Investments or its successors easements
<br />through which the sewer line herein will run; and
<br />WHEREAS, the easement affects the Val Vista Subdivision in that it
<br />adversely affects Lots 29, 30, 31, 32, 41, 42, 43, 52, 53,
<br />54, 63, 64, 65, 74, 75, 76, 85, 86 and 87;
<br />WHEREAS, the developer of the property within the Val Vista sub-
<br />division has requested that variances from the rear yard
<br />setback requirements be granted with respect to the lots
<br />herein in order that development of said lots not violate
<br />the rear yard setback requirements of Title II, of the
<br />Ordinance Code of the City of Pleasanton, and further,
<br />requests such variances from the side yard setback re-
<br />quirements as may be occasioned by the granting of
<br />variances from rear yard setback requirements herein.
<br />WHEREAS, the granting of such variances appears desirable and in
<br />the public interest in that settlement of the condemna-
<br />tion suit will be hastened and damages or compensation
<br />for said easements reduced.
<br />NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:
<br />That, consistent with the provisions of Section 2-11.23
<br />of the Ordinance Code of the City of Pleasanton, the
<br />Zoning Administrator is authorized and directed to grant
<br />variances from the rear yard setback requirements of
<br />City for Lots 29, 30, 31, 32, 41, 42, 43, 52, 53, 54, 63,
<br />64, 65, 74, 75, 76, 85, 86 and 87, as shown on Tentative
<br />Map No. 2955 of Besco, Inc., in order that said lots
<br />accommodate the developer's houses without violating the
<br />provisions of the City requirements with respect to rear
<br />yard setbacks.
<br />2. That the Zoning Administrator is authorized and directed
<br />to grant such variances from the side yard setback as are
<br />occasioned by variances granted above, provided however,
<br />that granting such variances will not create side yards
<br />of less than five (5) feet and that prior to the granting
<br />of such variances, site plans for the lots in question
<br />shall be furnished the Zoning Administrator.
<br />PASSED AND ADOPTED by the Planning Commission of the City of
<br />Pleasanton on the 25th day of March 1970, by the
<br />following vote:
