CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> RESOLUTION NO. 87-344 <br /> <br /> RESOLUTION DETERMINING SATISFACTORY COMPLIANCE OF <br /> CONDITIONS FOR LUND RANCH WILLIAMSON ACT AGRICULTURAL <br /> PRESERVE CONTRACT 1974-15 CANCELLATION AND AUTHORIZATION <br /> FOR CITY CLERK TO PREPARE AND RECORD CERTIFICATE OF <br /> CANCELLATION <br /> <br />WHEREAS, the City was in receipt of an application from Shea <br /> Homes for cancellation of Williamson Act Agricultural <br /> Preserve Contract 1974-15 under the provisions of <br /> California Government Code Section 51282.1 to allow <br /> development of the site for residential use consistent <br /> with City General Plan policies; and <br /> <br />WHEREAS, on November 18, 1986, Council adopted Resolution No. <br /> 86-544 approving tentative cancellation of said contract <br /> and setting forth conditions to be satisfied prior to <br /> final cancellation; and <br /> <br />WHEREAS, Council is in receipt of a request from Shea Homes to <br /> determine that such conditions have been satisfactorily <br /> complied with; and <br /> <br />WHEREAS, Council received the City staff's report and <br /> recommendation for determination of compliance; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: The City Council determines that the conditions set <br /> forth in Resolution No. 86-544 have been satisfied for <br /> the application of Shea Homes for Cancellation of <br /> Williamson Act Land Conservation Agreement for an <br /> approximately 53 acre site located generally in the area <br /> east of the terminus of Junipero Street and San Jose <br /> Drive. <br /> <br />Section 2: Council authorizes and directs the City Clerk to <br /> execute the Certificate of Cancellation for said <br /> contract and cause same to be recorded. <br /> <br />Section 3: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br /> <br />
