VI. ATTORNEY'S FEES <br />If City commences an action against Property Owner arising <br />out of or in connection with this Agreement, City shall be entitled <br />to have and recover reasonable attorney's fees and costs of suit. <br />VII. NOTICE <br />Any notice or communication required or provided for under <br />this Agreement shall be given in writing and sent by ordinary mail <br />to the following addresses: <br />CITY: City of Pleasanton <br />Attn: City Attorney <br />P.O. Box 520 <br />Pleasanton, CA 94566 <br />PROPERTY OWNER: Mr. and Mrs. Joe Macias <br />6248 Amber Lane <br />Pleasanton, CA 94566 <br />Any notification required to be made by the City Engineer <br />shall also be sent to the party shown as the property owner on the <br />latest equalized assessor's roll. Any party or successor in <br />interest may change the foregoing address by giving notice of a new <br />address to the other party in the manner herein provided. Notice <br />shall be considered received two days after the time of mailing. <br />VIII. SUCCESSORS IN INTEREST <br />This Agreement shall run with the land and be binding upon <br />any and all heirs, assigns, and successors in interest of Property <br />Owner having an interest in the property described in Exhibit "A". <br />IX. RECORDATION <br />This Agreement shall be recorded in the office of the County <br />Recorder of Alameda County. <br />X. RELEASE OF LIEN <br />City shall execute and deliver to Property Owner upon payment <br />of the above stated costs or appropriate substiution of security <br />for said improvements described in Paragraph I, upon Property <br />Owner's request, a quitclaim deed or other legal instrument, in <br />recordable form, which removes this Agreement from title to the <br />site. <br />- 3 - <br />
