residence domestic use, and is subject to intermittent water <br />service interruption at the sole discretion of City, without <br />notice to Owner. <br />If Owner does annex to the City and the adjacent property or <br />any portion of the adjacent property, generally known as Lot 4, <br />Pleasanton Tract, filed January 21, 1919, Book 16, Page 72, <br />(consisting of approximately nine acres), is annexed, Owner also <br />acknowledges that permanent water service will have to be <br />installed at Owner's expense. <br />5. Insurance. Owner further agrees to fulfill the <br />following: <br />a. Provide a Certificate of Insurance issued to the <br />City of Pleasanton from his insurance carrier <br />providing proof of Worker's Compensation and Policy <br />Number. Except if the Acting General Contractor is <br />not the Owner, then the General Contractor will <br />provide the City with the said Certificate of <br />Worker's Compensation Insurance prior to start of <br />construction. <br />b. Provide a certificate of Insurance from his <br />insurance carrier showing the amount of Public <br />Liability and Property Damage coverage and naming <br />the City of Pleasanton, its employees, and Agents <br />as an additional insured. Insurance coverage shall <br />be in at least the following amounts: <br />PUBLIC LIABILITY <br />General Bodily Injury - $1,000,000 Per Occurrence <br />General Property Damage - $ 100,000 Per Occurrence <br />or <br />Combined Single Limit on Bodily Injury and Property <br />Damage Liability - $1,000,000 <br />AUTOMOBILE LIABILITY <br />Bodily Injury - $ 500,000 Per Person/ <br /> $1,000,000 Per Occurrence <br />Property Damage - $ 100,000 Per Occurrence <br />or <br />Combined Single Limit on Bodily Injury and Property <br />Damage Liability - $2,000,000 <br />6. Attorney's Fees. In the event City shall initiate and <br />prevail in any action or suit for the enforcement of any of its <br />rights under this agreement, Owner shall pay to City a reasonable <br />attorney's fee as may be fixed by the court on account thereof. <br />7. Notices. All notices herein required shall be in <br />writing and delivered in person or sent by certified mail, <br />postage prepaid.
