• 17. Binding on Land and Successors. All covenants, promises and agreements contained in this agreement shall pertain to and do 'hereby expressly run with the land controlled by Subdivider and described herein. This agreement shall bind and inure to the parties hereto, including heirs, assigns, executors, administrators, and all other parties whether they succeed by operation of law or voluntary acts of Subdivider:. Signatures and execution of all-parties shall be acknowledged before a notary public. Either party may file and record this agreement with the Recorder of Alameda County. 18. Effect on Previous Agreement. The parties agree that this agreement shall be the sole subdivision agreement applicable to Tract 5129, Fairlands, Unit 9, in the City of Pleasanton. The sub- division agreement dated September 27, 1983 by and between First Pleasanton Investors and the City of Pleasanton is hereby rescinded and shall have no further force and effect upon the execution of this agreement.
