1. Purpose. The purpose of this Agreement is to assure (a) installation of landscaping in accordance with the landscape plan approved by the City and (b) continued maintenance and care of the landscaping. 2. Property Subject to Agreement. The property which is the subject of this Agreement is described in Exhibit "A". 3. Landscape Plan. The landscape plan shall be the final landscape plan approved by the Planning Division. A copy of said landscape plan will be kept on file with the City in the office of the Planning Director, Civic Center, 200 Old Bernal Avenue, Pleasanton, California. 4. Landscaping As A Benefit. Froperty Owner agrees that the landscaping which he is obligated to provide will materially benefit his Property. 5. Duty to Maintain Landscaping on the Property. Property Owner agrees to diligently maintain and care for the landscaping on the Property using generally accepted methods for cultivation and irrigation. Property Owner shall maintain that standard of care necessary to keep the landscaping in a healthy, attractive, and weed-free condition. Maintenance of landscaping shall in- elude replacement of plants as required to ensure the Project landscaping continues to meet the requirements of the landscape plan. The obligation of Property Owner, his assigns or succes- sors to maintain the landscaping shall continue for the duration of the existence on the Property of the structures comprising the Project. 6.
