He noted <br />that both additions were completed up to the point of an inspection on November 18, <br />2006. He noted that he would not have embarked upon unpermitted construction were it <br />not for the neighbors’ concerns about completing the project as quickly as possible. <br /> <br />In response to an inquiry by Commissioner Blank regarding whether he had known the <br />two additions required a permit but proceeded to build them without a permit because of <br />time pressure, Mr. Smith confirmed that had been the case and that they had commenced <br />the construction with permits to follow and had discussed this with his neighbors. <br /> <br />Chairperson Fox noted that the project plan of 21 items mainly contained interior items <br />but did not see the roof listed. Ms. Decker noted that it was listed on Item 28. <br /> <br />Mr. Smith detailed the background of the outcome of the hearing in April and described <br />the landscaping and other items that have been completed as depicted on the chart. He <br />noted that they sought some privacy for his family and would be adding landscaping at <br />the rear yard deck areas that were not shown on the plans. He noted that it would be very important to complete the stucco work before <br />the rainy season. <br /> <br />In response to an inquiry by Chairperson Fox regarding the time when work started, <br />Mr. Smith replied that they tried to start closer to 9:00 a.m. rather than 8:00 a.m. in order <br />to be considerate to the neighbors. <br /> <br />In response to an inquiry by Commissioner Olson regarding whether financing was in <br />place to complete the project, Mr. Smith confirmed that he still had the original financing <br />secured in March to complete the project. <br /> <br />Steve Neef, A&E Design Services, 1774 Old Tower Road, Livermore, noted that he was <br />the project engineer. He wished to emphasize that Mr. Smith was not attempting to <br />deceive the Building and Safety Division and noted that he had been contacted by <br />Mr. Smith whenever he made a modification to the plans.
