CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 87-545 <br /> <br /> RESOLUTION AUTHORIZING AN INCREASE IN THE SETTLEMENT OF <br /> CONDEMNATION ACTION (CITY VS. WARREN AVENUE ASSOCIATES, <br /> ET AL.) <br /> <br />WHEREAS, at its meeting of July 21, 1987, Council approved a <br /> settlement of City vs. Warren Avenue Associates, et al. <br /> in the sum of $17,650.00; and <br /> <br />WHEREAS, Burger King, the tenant of the land owner, Warren Avenue <br /> Associates, increased its demand by $2,415.00; and <br /> <br />WHEREAS, in order to make the landowner whole, which is the usual <br /> standard in a tenant/landowner eminent domain <br /> proceeding, staff recommends approval of the increase in <br /> settlement authority by the above stated amount; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: Authorizes settlement of the condemnation action of <br /> City vs. Warren Avenue Associates, et al., Action No. <br /> Hl15839-1, and payment of the sum of $20,265.00. <br /> <br />Section 2: Authorizes the Mayor to execute all documents <br /> necessary to implement the above settlement. <br /> <br />Section 3: Accepts a grant deed for the subject property and the <br /> appropriate City officers are instructed to take <br /> whatever action is necessary to implement said <br /> acceptance. <br /> <br />Section 4: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br /> <br />
