ORDINANCE NO. 1960 AN ORDINANCE APPROVING THE APPLICATION OF JEREMY AND JOSIE GARNISH FOR A PUD MAJOR MODIFICATION AND DEVELOPMENT PLAN, AS FILED UNDER CASE PUD-99-01-04M WHEREAS, Jeremy and Josie Barnish have applied for a PUD .major modification to an approved PUD development plan to allow an existing solid fence to remain, where open fencing is required, along a portion of the rear and side property lines of the property located at 4526 River Rock Hill Road and to modify Condition of Approval No. 6 of Ordinance No. 1918 (PUD-9-01-3M), adopted on June 21, 2005, such that requests for solid fencing may be approved by the Zoning Administrator; and WHEREAS, zoning for the property is PUD-RDR/LDR (Planned Unit Development -Rural Density Residential/Low Density Residential) District; and WHEREAS, the construction and location of accessory structures, including garages, carports, patios, swimming pools, and fences, are categorically exempt (Section 15303) from the requirements of the California Environmental Quality Act (CEQA); and WHEREAS, the City Council received the Planning Commission's positive recommendations for approval of the PUD major modification for the subject site; and WHEREAS, the City Council finds that the PUD major modification and development plan are consistent with the General Plan policies and the purposes of the PUD ordinance of the City of Pleasanton. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. Approves Case PUD-99-01-04M, the application of Jeremy and Josie Barnish for a PUD major modification to an approved PUD development plan to allow an existing solid fence to remain, where open fencing is required, along a portion of the rear and side property lines of the property located at 4526 River Rock Hill Road and to modify Condition of Approval No. 6 of Ordinance No. 1918 (PUD-9-01-3M), adopted on June 21, 2005, such that requests for solid fencing may be approved by the Zoning Administrator, subject to the conditions shown on Exhibit B, attached hereto and incorporated herein by this reference. SECTION 2. A summary of this ordinance shall be published once within fifteen (15) days after its adoption in "The Valley Times," a newspaper of general circulation published in the City of Pleasanton, and the complete ordinance shall be posted for fifteen (15) days in the City Clerk's office within fifteen (15) days after its adoption.
