Any party or successor <br />in interest may change the foregoing addresses by giving <br />notice of a new address to each other party in the manner <br />herein provided. Notice shall be considered received two <br />(2) days after the time of railing. <br />yIII. SUCCESSORS IN INTEREST <br />This agreement shall run with the land and be binding <br />upon any and all heirs, assigns, and successors in interest <br />of Developer having an interest in the property described in <br />Exhibit "A". Upon subdivision of the project site, the <br />obligations under this agreement of each parcel of the subdivi- <br />sion shall be limited to a pro rata amount of the total costs <br />-- whether by assessment district or other funding mechanisms -- <br />for all of said property as the acreage of the parcel bears <br />to the total acreage of .the project site. <br />~~IV . ~P.ECORDATION <br />This agreement shall be recorded in the office of the <br />County Recorder of Alameda County. Upon Developer's completion <br />of its obligations described herein, the City shall execute <br />a recordable instrument to eliminate this agreement as an <br />exception to title of the project site. <br />-10- <br />
