RESOLUTION NO. 12-577 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON APPROVING THE THIRD AMENDMENT TO THE FREEWAY MAINTENANCE AGREEMENT WITH CALTRANS FOR FUTURE STATE HIGHWAYS IN THE CITY OF PLEASANTON WHEREAS, an Agreement for maintenance of State Highways, as provided for in Section 130 of the Streets and Highways Code, was executed by the City of Pleasanton on February 6, 1990, and by the State of California on February 27, 1990; and WHEREAS, the Agreement authorizes the City of Pleasanton to operate and maintain Caltrans owned traffic signals within the City of Pleasanton; and WHEREAS, this Agreement has been amended previously to include additional traffic signals; and WHEREAS, traffic signals have been constructed at the I-680/Bernal Avenue Interchange; and WHEREAS, traffic signals will be constructed at the I-580/Foothill Road Interchange; and WHEREAS, the parties desire to amend the Agreement to include the I-680/Bernal Avenue Interchange and the I-580/Foothill Road traffic signals. NOW, THEREFORE BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING: SECTION 1. The Freeway Maintenance Agreement between the City of Pleasanton and the State of California is hereby amended to include new page number 6a dated November 20, 2012, attached and incorporated herein by reference, which shall be substituted for like numbered pages in said Agreement, and shall cancel and supersede previous like numbered pages, and become a part of said Agreement for all purposes. SECTION 2. All other terms and conditions of the Agreement shall remain in full force and effect.
