STATE will inspect the <br />protection, relocation or removal of such utilities. If there <br />are costs of such protection, relocation or removal which STATE <br />and/or CITY must legally pay, STATE will bear the cost of said <br />protection, relocation or removal within STATE's right of way anc, <br />CITY will bear the cost of protection, relocation or removal <br />outside STATE's right of way. <br />(11) The execution of this Agreement. by CITY grants to <br />STATE the right to enter upon CITY-owned lands to construct the <br />PROJECT referred to herein. <br />(12) In the construction of said work, STATE will i <br />furnish a representative to perform the usual functions of a <br />Resident Engineer, and CITY may, at no cost to STATE, furnish a <br />representative, if it so desires; said representative and <br />Resident Engineer will cooperate and consult with each other, bu~:l <br />the decisions of STATE's engineer shall prevail. <br />*~ <br />-6- <br />
