~ ~ CITY AGREES: i (1) To deposit with STATE within 25 days of receipt oi`.j billing therefor (which billing will be forwarded immediately I~ following STATE's bid advertising date of a construction contract:, for PROJECT), the amount of $11,600, which figure represents CITY's estimated share of the expense of preparation of plans any'. specifications, construction engineering and construction costs required to complete the PROJECT as shown on Exhibit A. In no event shall CITY's total obligation for said. costs, excluding costs referred to in Section III, Article (10), under this Agreement exceed the amount of $12,800; provided that CITY may, at its sole discretion, in writing, authorize a greater amount. (2) CITY's share of the construction cost (estimated to be $9,000), shall be the actual construction cost of the portion of PROJECT located outside STATE's right of way as determined after completion of work and upon final accounting of costs. (3) CITY's share of the expense of preparing plans an<: specifications (estimated to be $1,200), shall be an amount equal to 13 percent of CITY's share of .the actual final construction cost.
