1 (4) CITY is willing to bear the cosh of the addition<:1 2 rights of way required for the PROJECT; to bear the costs not.- 3 normally. borne by utility owners of all utility protection, ~ relocation or removal; and to bear approximately 8.5 percent (ox 5 100 percent less the Federal reimbursement percentage in effect a 6 the time of programming) "of the construction costs of PROJECT. ~ (5) STATE is willing to bear the entire. cost of right: 8 of way services, preliminary engineering, construction 9 engineering, traffic striping, .pavement marking and traffic sigrs. 10 (6) This Modification of Agreement (which .will replace 11 the said. prior agreement upon. execution) sets forth the revised 12 terms and conditions under which rights of way are to be acquired i3 and under which the PROJECT is to be designed, constructed, 1~' financed and maintained.. l~ SECTION I 16 STATE AGREES: 1? (1) To perform, at STATE's sole expense, the recessar.y 18 right of way engineering, appraisals and negotiations required i:o 19 acquire in CITY's name the additional rights of-way required fox 20 the PROJECT. 2l (2) To acquire through .proceedings in eminent domain 22 any parcel or parcels required for the PROJECT that can not be 23 acquired by negotiated settlement. STATE will be responsible fr-r 2~ all matters relative to the .legal aspects of acquisition through 25 condemnation. All right of way acquired through condemnation will -2, ~cD8o2
