CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 87-523 <br /> <br /> RESOLUTION VACATING A COMMON AREA EASEMENT ON LOT 4A OF <br /> LOT LINE ADJUSTMENT 87-11 <br /> <br />WHEREAS, on December 1, 1987, the City Council received a staff <br /> report (SR 87:513) recommending the vacation of a common <br /> area easement on Lot 4A of Lot Line Adjustment 87-11, <br /> more particularly described in Exhibit "A", attached <br /> hereto and incorporated herein by this reference; and <br /> <br />WHEREAS, due to the redesignated land use to high density <br /> residential, the existing common area easement is no <br /> longer needed to serve the original intended use, which <br /> was for a decorative sign for the entrance to Hacienda <br /> Business Park; and <br /> <br />WHEREAS, the date of dedication of the public service easement <br /> was between one and five years preceding the proposed <br /> vacation and the easement has not been used since it was <br /> dedicated; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: Pursuant to Chapter 4 of the Streets and Highways <br /> Code and based upon the findings above establishing the <br /> necessity to vacate the common area easement in a manner <br /> meeting the requirements of Section 8333, Subsection C <br /> of the Streets and Highways Code, those portions of the <br /> public service easement described in Exhibit "A" are <br /> hereby vacated. <br /> <br />Section 2: The City Clerk shall cause a certified copy of this <br /> resolution of vacation to be recorded in the office of <br /> the Alameda County Recorder. <br /> <br />Section 3: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br /> <br />
