C. "Housing services" means those services provided and associated with the use or <br />occupancy of a mobilehome space, including, but not limited to, repairs, insurance, maintenance, <br />replacement, painting, light, heat, water, laundry facilities and privileges, refuse removal, <br />parking, recreation facilities, security service and any other benefits, privileges or facilities. <br />D. "Mobilehome pazk" or "pazk" means any azea or land within the City of Pleasanton where <br />two (21_or more mobilehome spacesare-renteds or held-out- for rent, to accommedat~-- _ - - <br />mobilehomes used for human habitation. <br />E. "Monthly rent" is the monthly space rent for each mobilehome space. <br />F. "Pazk Owner" is any owner of the Fairview Trailer Pazk, a mobilehome park within the <br />City of Pleasanton.----- ---- _ _ _ _ ----__ --- - - __ -- -- - _ - - -_.. _- _ ___ <br />G. "Resident" or "tenant" means any homeowner or other person who lawfully occupies a <br />mobilehome. <br />H. "Service reduction" means any reduction in housing services which results in a cost <br />savings to the Pazk Owner without a corresponding reduction in the monies demanded or paid <br />for space rent. <br />I. "Space rent" means the consideration, including any bonus, benefits, or gratuity, <br />demanded or received in connection with the use and occupancy of a mobilehome pazk or for the <br />transfer of a lease for pazk space, services and amenities, subletting and security deposits, but <br />exclusive of any amounts paid for the use of the mobilehome dwelling unit. <br />J. "Transfer of ownership" means any voluntary or involuntary sale, assignment or transfer <br />of ownership of a mobilehome or of any interest in the mobilehome, including, but not limited <br />to, a fee simple interest, a joint tenancy interest, a life estate, or an interest evidenced by a land <br />contract by which possession of the mobilehome is transferred and the resident retains title, but <br />excluding transfers by a living trust, lease, gift, devise or inheritance to an existing spouse, <br />surviving joint tenant, or a spouse as part of a dissolution proceeding or in connection with <br />marriage. <br />II. RENT STABILIZATION ORDINANCE <br />The City has adopted a Mobilehome Rent Stabilization Ordinance, codified in Chapter <br />6.60 of the Pleasanton Municipal Code. The Pazk Owner who is a signatory to this Agreement <br />and who is operating its pazk in compliance with this Agreement shall be exempted from the <br />Ordinance during the term of this Agreement. Except as otherwise provided herein, issues <br />concerning whether the Pazk Owner is operating the Pazk in good faith compliance with this <br />Agreement shall be resolved as provided in Article III. <br />3 <br />
