X. HOMEOWNER AS THIRD-PARTY BENEFICIARY <br />This Agreement is intended to benefit Residents and the Properly Owner. Every Resident <br />is deemed to be a third party beneficiary of this Agreement with the authority to enforce its <br />provisions. <br />XI. TERM <br />The Agreement shall take effect on October 1, 2007 and shall terminate on December 31, <br />2012, unless terminated earlier under Article XV. <br />XII. PROCEDURE FOR FUTURE RENT REVIEW <br />In January 2012, the City shall schedule a meeting of the Property Owner and the <br />Residents to discuss whether there are other terms and conditions upon which a new Agreement <br />may be adopted. <br />XIII. MAINTENANCE OF AMENITIES AND SERVICE LEVELS <br />As of the effective date hereof, the Property Owner provides certain amenities and <br />service levels to the Residents. The Property Owner shall not reduce these amenities or service <br />levels ("service reductions") without meeting and conferring with the Residents prior to any <br />reduction; provided, however, that nothing provided herein shall preclude the Property Owner <br />from billing Residents separately for utility service fees and charges as provided in Civil Code, <br />Section 798.41. In addition, Maintenance Standards and Schedule applicable to the Park are <br />attached hereto as Exhibits F and G and are incorporated herein by reference. Any breach of the <br />Maintenance Standards and Schedule shall be subject to the Dispute Resolution Procedures in <br />Article III of this Agreement and/or shall be grounds for termination of this Agreement. <br />XIV. NOTICE <br />All notices herein required shall be in writing and delivered in person or sent by first <br />class mail, postage prepaid.
