X. HOMEOWNER AS THIRD-PARTY BENEFICIARY This Agreement is intended to benefit Residents and the Properly Owner. Every Resident is deemed to be a third party beneficiary of this Agreement with the authority to enforce its provisions. XI. TERM The Agreement shall take effect on October 1, 2007 and shall terminate on December 31, 2012, unless terminated earlier under Article XV. XII. PROCEDURE FOR FUTURE RENT REVIEW In January 2012, the City shall schedule a meeting of the Property Owner and the Residents to discuss whether there are other terms and conditions upon which a new Agreement may be adopted. XIII. MAINTENANCE OF AMENITIES AND SERVICE LEVELS As of the effective date hereof, the Property Owner provides certain amenities and service levels to the Residents. The Property Owner shall not reduce these amenities or service levels ("service reductions") without meeting and conferring with the Residents prior to any reduction; provided, however, that nothing provided herein shall preclude the Property Owner from billing Residents separately for utility service fees and charges as provided in Civil Code, Section 798.41. In addition, Maintenance Standards and Schedule applicable to the Park are attached hereto as Exhibits F and G and are incorporated herein by reference. Any breach of the Maintenance Standards and Schedule shall be subject to the Dispute Resolution Procedures in Article III of this Agreement and/or shall be grounds for termination of this Agreement. XIV. NOTICE All notices herein required shall be in writing and delivered in person or sent by first class mail, postage prepaid.
