NOW, THEREFORE, in consideration of the faithful performance of the terms, <br />conditions, covenants and promises set forth herein, the parties agree as follows: <br />1. Owner may continue to impose a rent increase on the residents as set forth in Article <br />VI, Pazagraphs A and B of the 2007 Agreement Providing for Stabilization of <br />Mobilehome Space Rents. <br />2. Owner shall, in perpetuity, maintain, repair and replace all Capital Improvements in <br />the Pazk, including those that exist today or any that are constructed in the future. <br />3. Within the next 60 months, Owner shall, at a minimum, initiate and pursue diligently <br />to completion the following: <br />4. This Agreement is intended to benefit Owner, City and the residents of the Pazk. <br />Every resident is deemed to be a third party beneficiary of this Agreement with the authority to <br />enforce its provisions. <br />S. All notices shall be in writing and red in person or sent by first class mail, <br />postage prepaid. In the event that it becomes necessary for any party to bring a lawsuit to enforce any <br />of the provisions of this Agreement, a court of competent jurisdiction may determine and fix a <br />reasonable attorney fee to be paid the prevailing party. <br />7. This Agreement shall be recorded in Alameda County, shall run with the land and is <br />binding on the heirs, successors and assigns of the parties hereto. <br />2 EXHIBIT ~ <br />
