NOW, THEREFORE, in consideration of the faithful performance of the terms, conditions, covenants and promises set forth herein, the parties agree as follows: 1. Owner may continue to impose a rent increase on the residents as set forth in Article VI, Pazagraphs A and B of the 2007 Agreement Providing for Stabilization of Mobilehome Space Rents. 2. Owner shall, in perpetuity, maintain, repair and replace all Capital Improvements in the Pazk, including those that exist today or any that are constructed in the future. 3. Within the next 60 months, Owner shall, at a minimum, initiate and pursue diligently to completion the following: 4. This Agreement is intended to benefit Owner, City and the residents of the Pazk. Every resident is deemed to be a third party beneficiary of this Agreement with the authority to enforce its provisions. S. In the event that it becomes necessary for any party to bring a lawsuit to enforce any of the provisions of this Agreement, a court of competent jurisdiction may determine and fix a reasonable attorney fee to be paid the prevailing party. 7.
