G. City has discussed this proposal with the residents of the Park and the residents aze in favor of the proposal. NOW, THEREFORE, in consideration of the faithful performance of the terms, conditions, covenants and promises set forth herein, the parties agree as follows: 1. Owner may impose a rent increase on the residents as set forth in Article IV, Paragraph C of the 2007 Agreement Providing for Stabilization of Mobilehome Space Rents. 2. Owner shall, in perpetuity, maintain, repair and replace all Capital Improvements in the Park, including those that exist today or any that are constructed in the future. 3. Within the next 30 months, Owner shall, at a minimum, initiate and pursue diligently to completion the following: a. repair/replace the storm drain line located ; b. repair the sewer line in three places as identified in the sewer system survey conducted in Mazch 2007; c. reconstruct Cereza Drive and other roads serving the east side of the Park; and d. repair (by dig outs, crack sealing and slurry coating) the roads serving the Pazk west of Cereza Drive. '--"--' Formatted: Indent: Left: 0.75" Prior to undertaking the work set forth in subsections c and d above, Owner shall contact the various utility companies that have utilities within the streets (e.g., the City of Pleasanton, PG&E, AT&T, Comcast, etc.), advise them of the proposed work and the timing thereof, and request that if they are contemplating any work on their utility tines within the Park that such work be done prior to the Owner's proposed work. 4. This Agreement is intended to benefit Owner, City and the residents of the Pazk. Every resident is deemed to be a third party beneficiary of this Agreement with the authority to enforce its provisions. 5. All notices shall be in writing and delivered in person or sent by first class mail, postage prepaid.
