OTHER TRI-VALLEY CITIES' CONTRIBUTION LIMITS. In the Tri-Valley, the
Cities of Dublin and Livermore have adopted contribution limits of $300 and $250,
respectively. San Ramon does not have a contribution limit.
OUT-OF-AREA CONTRIBUTORS. In acknowledgement of freedom of speech
and association, contribution limits may not distinguish between local contributors
versus contributors from outside of the City. In practice, interested persons may review
the Campaign Statements, which list the name, address, occupation and place of
employment for every person contributing $25.00 or more (in cash or equivalent) to a
candidate or candidate's committee, to determine what amount of support a candidate
receives from outside of the City.
Providing Direction to Staff about Limits on Contributions. If the City
Council considers enacting an ordinance to limit contributions by
individuals, businesses, organizations or committees to candidates for
local office, the City Council should provide staff with direction regarding
the following issues:
- Amount of limit (e.g. $250, $300, or some other amount)
- Election period during which limit would be in force, for example:
Option 1 -Allow contributions to begin 31 days (or some other period)
following the prior election, and allow contributions to continue only until 7
days prior to the date of the election at issue -which will allow all
contributions to be reported in the final Campaign Statement due 4 days
prior to the election.
Option 2 - Allow contributions to begin 31 days (or some other period)
following the prior election, and allow contributions to be made for a set
number of days after the election date, which will allow for campaign debt
retirement.
Option 3 - Allow the contributor to indicate which election the contribution
is intended to apply to, and allow contributions to be made after an
election date to be attributed to the just-decided election for a set period of
time.
Expenditure Limit -Voluntary Pledge.
Expenditure limits are a direct restraint on speech and association. Expenditure limits
have only been legally upheld when tied to the acceptance of public funds for an
election campaign. As no city in California has provided public funding of campaigns for
local office, expenditure limits are utilized only as voluntary pledges.
Page3of6
