The July 11, 2007 Planning Commission meeting <br />minutes are attached for the Council's information (Attachment 5). <br />At the meeting, the Commission recommended three modifications to the conditions of <br />approval: <br />Add a new condition that the applicant shall work with staff to diversify the <br />stairs/entryways of homes facing Peters Avenue and to soften the streetscape <br />along Peters Avenue through landscaping. <br />2. Add a new condition that the applicant shall install a door in the Unit D garage to <br />provide direct access into the unit. <br />3. Modify the second sentence of Condition No. 12 as follows: "The project/building <br />developer m°„~a,-~h~ shall comply with the following requirements for making all <br />houses on the ~ property photovoltaic ready." <br />Staff and the applicants agree that these conditions are appropriate. In addition, staff <br />has included in the draft conditions of approval (Exhibit B) being presented to Council, <br />Engineering's standard Urban Stormwater Runoff conditions that were inadvertently left <br />out of the conditions approved by the Planning Commission. <br />Public Notice and Comment <br />Notice of this application was sent to all property owners living within 1,000 feet of the <br />subject property. As of the writing of this staff report, staff has received no public <br />comment. <br />ENVIRONMENTAL ASSESSMENT <br />An Environmental Impact Report was prepared and certified for the Downtown Specific <br />Plan. It was approved by the City Council on March 5, 2005. The Environmental Impact <br />Report anticipated that ahigh-density residential project, such as that proposed, would <br />be located on the project site. The California Environmental Quality Act (CEQA) <br />specifies that individual residential development projects that are prepared pursuant to <br />the requirements of an adopted specific plan, for which an EIR has been prepared and <br />certified, are exempt from additional environmental review. Therefore, no environmental <br />document accompanies this report. <br />CONCLUSION <br />Staff believes that, as conditioned, the proposed PUD is in keeping with the themes, <br />policies, and requirements of the Downtown Specific Plan and is compatible with the <br />surrounding area. The proposed site development standards have been created in <br />accordance with the intent of the Specific Plan and the Downtown Design Guidelines. <br />The development of this PUD would, therefore, be carried out in a manner that <br />preserves the unique mixed-use character desired for Downtown Area. <br />Page 6 of 7 <br />
