Exhibit BC-2 <br />O~a#~Final Conditions of Approval <br />PUD-33, Oak Grove Development/Lin Property <br />City Council eta October 2, 2007 <br />Project Specific Conditions: <br />All aspects of the proposed residential/open space development covered by <br />these approvals shall conform to the development agreement titled, <br />"Development Agreement By And Between City Of Pleasanton And Jennifer Lin," <br />attached as Exhibit "D", and herein referred to as the Development Agreement. <br />If there are any conflicts or inconsistencies between these conditions of approval <br />and the terms of the Development Agreement, the conditions shall be <br />subordinate to the Development Agreement. <br />2. The 51-unit subdivision including open space, public improvements, landscaping, <br />buildings, etc., covered by this approval shall be constructed/installed <br />substantially as shown on the development plans, Exhibit "A", dated "Received, <br />August 24, 2007" on file with the Planning Department, except as modified by the <br />following conditions. Exhibit "A" is comprised of the development plan, the Final <br />Environmental Impact Report, Oak Grove Design Guidelines (includes Oak <br />Grove Residence Lot Design Guidelines and Oak Grove Open Space and <br />Common Area Design Guidelines), Planning/Development-Level Geologic and <br />Geotechnical Investigations, Tree Report of the Kottinger Hills Subdivision, dated <br />October 8, 2003. Minor changes to the development plans may be allowed on a <br />case-by-case basis subject to the review and approval of the Planning Director if <br />the Planning Director finds the changes to be in substantial conformance to the <br />approved exhibits referenced by the following conditions. <br />3. All aspects of the proposed development including subsequent approvals by the <br />City shall conform to the Mitigation, Monitoring, and Implementation Plan (MMIP), <br />Exhibit B-5. The applicant shall update the MMIP with the tentative subdivision <br />map application and thereafter with each final subdivision map application, for <br />review and approval by the Planning Director. <br />4. The project developer shall obtain all agency environmental permits, i.e., <br />404 permit, 401 certification, Section 7 biological opinion, and a 1602 agreement, <br />prior to the recordation of the first final subdivision map or prior to the issuance of <br />a grading permit and shall obtain any other applicable City permits prior to the <br />commencement of any construction, or as reviewed and approved by the <br />Planning Director and City Engineer. <br />5. The project developer shall pay any and all fees to which the property covered by <br />this PUD development plan approval is subject to as provided in these conditions <br />City Council October 2. 2007 Page 1 of 41 <br />
