CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. 87-507 ACCEPTANCE OF DEED FROM CHANG SU-O LIN FOR PARCEL 3 OF PARCEL MAP 3681 WHEREAS, the City is in receipt of a deed from Chang Su-O Lin to the City of Pleasanton, a copy of which is attached hereto and incorporated herein by this reference; and WHEREAS, at its meeting of November 17, 1987, the City Council received a report from the City Attorney indicating that the acceptance of this deed is in the public interest; and WHEREAS, in conjunction with development o the adjacent parcel, it became necessary to designate sound wall locations and determine the probable location of the West Las Positas interchange with 1-680. As a result of the environmental review process, owner was required to reserve Parcel 3 of parcel Map 3681 for potential use as part of the West Las Positas/I-680 interchange project° Thus, owner has been unable to process development plan approval for the property and this purchase is necessary to alleviate potential hardship on the owner; and WHEREAS, City has the power of eminent domain to acquire this property for the purpose intended and in the absence of an agreement would pursue an action in condemnation. Owner is making this conveyance under threat of condemnation; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1: The Grant Deed from Chang Su-O Lin to the City of Pleasanton for Parcel 3 of Parcel Map 3681 is hereby accepted and the appropriate City officers are instructed to take whatever action necessary to implement said acceptance. Section 2: This resolution shall become effective immediately upon its passage and adoption.
