AMERICAN SPECIALTY HEALTH PLANS GROUP SUBSCRIBER AGMT 1998

a AMERICAN SPECIALTY HEALTH PLANS, INC. formerly the American Chiropractic Network Health Plan GROUP SUBSCRIBER AGREEMENT American Specialty Health Plans, formerly the American Chiropractic Network Health Plan, a California Corporation, (hereinafter called "ASHP"), and the employer, association, labor union trust, or other entity specified as "GROUP" on the Cover Sheet, hereinafter called "Group", agree as follows: RECITAL OF FACTS ASHP is a specialty health care service plan which arranges for and facilitates the provision of Chiropractic Services to persons enrolled as Members on a prepaid and direct services basis through contracts with associations of licensed Chiropractors. Group is an employer, organization or association which desires to provide Chiropractic Services for its eligible Members. In consideration of the Group's application for the benefits provided under this Agreement and the periodic payment of premiums by Group to ASHP on behalf of Members, ASHP agrees to arrange or provide for Chiropractic Services subject to all the terms and conditions of this Group Subscriber Agreement. 1. 1.01 Agreement. Agreement is this Group Subscriber Agreement, including but not limited to the Cover sheet, appropriate attachments, and any amendments hereto. 1.02 Chiropractic Appliances. Chiropractic Appliances are support type devices prescribed by a Participating Chiropractor. These shall be restricted to the following items to the exclusion of all others: elbow supports, back supports (thoracic), cervical collars, cervical pillows, heel lifts, ice packs, support/lumbar braces, lumbar cushions, orthotics, wrist supports, rib belts and home traction units (cervical or lumbar). 1.03 Chiropractic Services. Chiropractic Services are services rendered or made available to a Member for treatment or diagnosis of Neuromuscular-Skeletal Disorders. 1.04 Copayments. Copayments are fees payable pursuant to this Agreement by the Member to a Participating Chiropractor at the time of the provision of Chiropractic Services which are in addition to the Health Plan Premiums paid by Group. 1.05 Cover Sheet. Cover sheet is the Group Subscriber Agreement Cover Sheet which is incorporated into Agreement. 1.06 Dependent. Dependent is any spouse or unmarried child (including astep-child or adopted child) of Subscriber who is enrolled hereunder, who meets all the eligibility requirements set forth in Section 2.03 and for whom applicable Health Plan Premiums are received by ASHP. 1.07 Eligibility Information. Eligibility Information is a database provided to ASHP by Group on a monthly basis which contains a list of all eligible Subscribers and Dependents for the applicable month. 1.08 Emergency Services. Emergency Services are rendered for the sudden unexpected onset of an injury or condition affecting the neuromuscular-skeletal system which manifests itself by acute symptoms of sufficient severity, including severe pain, requiring immediate chiropractic attention. 1.09 Enrollment. Enrollment is the execution of the ASHP Enrollment Form by the Subscriber on behalf of the Subscriber and his or her Dependents, and acceptance thereof by ASHP, conditional upon the execution of this Agreement by Group and ASHP and the timely payment of applicable Health Plan Premiums by Group.
