• <br />City's Housing Fund at the time of. securing building permits. <br />B. -Public Needs <br />In consideration of the public needs created by the <br />project shown in PUD-80-3 (i.e. all 27 acres shown. on Tract 5129) <br />Developer agreed in Condition ~~2 of PUD-80-3 to contribute <br />one-half of the: cost of abridge across. the Arroyo Mocho at <br />Martin Avenue in an amount not to exceed $250,000..00. Developer <br />hereby agrees that his obligation is in the amount of $250,000.00 <br />City 'agrees that th obligation can be paid based upon a prorata <br />allocat-ion. of the $250,000.00 cost to each of the 113 lots <br />anticipated within the area. of Tract 5129. Therefore, Developer <br />agrees to pay $2,212.00 at the time of issuance of each. building <br />permit within.. the 27 acres of Tract 5129. <br />IV. SEWAGE CAPACITY <br />City agrees to use itsbestefforts toreservecapacity <br />sufficient for outstanding valid sewer permits, but this <br />agreement does not guarantee the availability of sufficient <br />sewage treatment capacity to serve the Project; building <br />permits may be withheld if sewage treatment capacity is <br />determined by City not to be available at the time building <br />permits are applied for. In the event sewage treatment <br />capacity is not available-to enable Developer to meet the <br />development schedule contained in Paragraph I, the Developer <br />and City agree to negotiate amendments to this long-term <br />.agreement which would as near as is feasible carry out the <br />intent of this agreement given the availability of sewage <br />treatment capacity. <br />"~~~_ <br />
