<br />9. Term of Agreement. <br />This Agreement shall remain in <br />a term and period equal to the period of <br />Section 4 herein, and as said period may <br />Section 8 herein. <br />10. Recordation. <br />The Developer hereby agrees and <br />the City or its representative to record <br />-~ <br />11 force and effect for <br />compliance set forth in <br />be extended pursuant to <br />irrevocably authorizes <br />this Agreement in the <br />property records of the County of Alameda, California. <br />11. Covenants to Run With the Land .', <br />The Developer hereby subjects t e Property to the <br />covenants, reservations and restrictions set forth in this <br />Agreement. The City and the Developer h~reby declare their <br />express intent that the covenants, reservations set forth herein <br />shall be deemed covenants running with tY~e land and shall pass to <br />and be binding upon the Developer's successors in title to the. <br />Property; provided, however, that on the~ltermination of this <br />Agreement said covenants, reservations artd restrictions shall <br />expire. Each and every contract, deed o~ other instrument <br />hereafter executed covering or conveying the Property, or any <br />portion thereof, shall conclusively be h ld to have been <br />executed, delivered and accepted subject'to such covenants, <br />reservations and restrictions, regardles$ of whether such <br />covenants, reservations and restrictions are set forth in such <br />contract, deed or other instruments..
