PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. PC-2006-57 <br />RESOLUTION APPROVING A CONDITIONAL USE PERMIT FOR HUAI MING CHANG, <br />SALON ART, AS FILED UNDER CASE PCUP-180 <br />WHEREAS, Huai Ming Chang, Salon Art, has applied for a conditional use permit to operate <br />an art school for children ages 7 to 16, Monday through Friday from 2:00 p.m. to <br />60 p.m. and Saturday and Sunday from 10:00 a.m. to 6:30 p.m., in an existing <br />building located at 173 Spring Street, Suite 250; and <br />WHEREAS, zoning for the property is C-C (Central Commercial) District, Downtown <br />Revitalization District, Core Area Overlay District; and <br />WHEREAS, at its duly noticed public hearing of October 25, 2006, the Planning Commission <br />considered all public testimony, relevant exhibits, and recommendations of the <br />City staff concerning this application; and <br />WHEREAS, projects of this nature are categorically exempt from the requirements of the <br />California Environmental Quality Act (CEQA); and <br />WHEREAS, the Planning Commission made the following findings: <br />The proposed location of the conditional use is in accordance with the objectives of the <br />zoning ordinance and the purpose of the district in which the site is located. <br />The objectives of the zoning ordinance include fostering a harmonious, convenient, workable <br />relationship among land uses; protecting existing land use from inharmonious influences and <br />harmful intrusions; and ensuring that public and private lands ultimately are used for the <br />purposes which are most appropriate and beneficial to the City as a whole. The proposed art <br />school would provide instruction lessons to local children. In the past, the City has allowed <br />similar uses to be located in the Downtown area. None of these teaching-oriented businesses has <br />created any impacts on surrounding businesses. <br />The subject site is zoned C-C (Central -Commercial) district, and it is in the Downtown <br />Revitalization District, where a mix of office/commercial/personal service uses surrounds it. <br />Based on the proposal, the art school is a quiet use as instructions would be provided at a <br />low-volume voice level, and students would focus on paintings and drawing. The proposed art <br />school would be disruptive to the neighboring businesses/tenants. Therefore, this first finding <br />can be made <br />
