PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. PC-2006-52 <br />RESOLUTION DENYING THE APPLICATION OF DUSTIN AND ROBIN BOYCE FOR <br />ADMINISTRATIVE DESIGN REVIEW AND A VARIANCE FROM THE PLEASANTON <br />MUNICIPAL CODE, AS FILED UNDER CASE PADR-1338/PV-131 <br />WHEREAS, Dustin and Robin Boyce have applied for administrative design review approval <br />to demolish approximately 470-square-feet of the existing home and to construct <br />an approximately 2,222-square-foot two-story addition, an approximately <br />833-square-foot non-habitable basement, and an approximately 950-square-foot <br />detached garage; and for a variance from the Pleasanton Municipal Code to <br />increase the floor area ration from 40 percent to 45 percent, reduce the right <br />(south) side yard setback from five feet to the existing 3.85 feet, and increase the <br />height of the garage from 15 feet to 20.5 feet at the property located at <br />4546 Second Street; and <br />WHEREAS, zoning for the property is R-1-6,500 (Single-Family Residential) District; and <br />WHEREAS, at its duly noticed public hearing of September 27, 2006, the Planning <br />Commission considered all public testimony, relevant exhibits, and <br />recommendations of the City staff concerning this application; and <br />WHEREAS, projects of this nature are categorically exempt from the requirements of the <br />California Environmental Quality Act (CEQA). <br />WHEREAS, the Planning Commission determined that the findings could not be made for the <br />variances from the Pleasanton Municipal Code to increase the floor area ratio, <br />decrease the side yard setback, and increase in the height of the garage. <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br />Section 1. Denies Case PADR-1338/PV-131, the application of Dustin and Robin Boyce for <br />administrative design review approval to demolish approximately 470-square-feet <br />of the existing home and to construct an approximately 2,222-square-foot <br />two-story addition, an approximately 833-square-foot non-habitable basement, <br />and an approximately 950-square-foot detached garage; and for a variance from <br />the Pleasanton Municipal Code to increase the floor area ration from 40 percent to <br />45 percent, reduce the right (south) side yard setback from five feet to the existing <br />3.85 feet, and increase the height of the garage from 15 feet to 20.5 feet at the <br />property located at 4546 Second Street. <br />
