EXHIBIT B <br />CONDITIONS OF APPROVAL <br />PCUP-178, The Cheesecake Factory <br />1350 Stoneridge Mall Road <br />September 13, 2006 <br />The operation of the proposed use shall conform substantially to Exhibit A, dated <br />"Received September 8, 2006", on file with the Planning Department, except as modified <br />by these conditions. Minor modifications to the operation of the use and conditions of <br />approval may be approved by the Planning Director if determined to be in substantial <br />conformance with the approved use permit. <br />2. The Cheesecake Factory is allowed to serve alcoholic beverages with food from <br />11:00 a.m. to 1:00 a.m., Monday through Saturday, and from 10:00 a.m. to 1:00 a.m., <br />Sunday. <br />The Cheesecake Factory will be operated as a restaurant bar featuring food beverage <br />service only. There will be no live music, DJ music, nor dancing. The restaurant <br />employees shall dispose of waste or recyclables in the trash enclosure area operated by <br />the Stoneridge mall. <br />4. In the event that the applicant proposes to modify the hours or other aspects of the <br />restaurant/bar operation, the modification shall be subject to the review of the Planning <br />Director. The Planning Director may approve the modification or refer the matter to the <br />Planning Commission if judged to be substantial. <br />5. The business owner or designated representative shall maintain the area surrounding the <br />restaurant/bar and outdoor dining areas in a clean and orderly manner at all times. The <br />business owner shall regularly monitor the area outside of the restaurant/bar to ensure <br />peace and quiet. <br />6. If operation of this use results in conflicts pertaining to parking, interior or exterior noise, <br />vibrations, traffic/circulation, litter, odors, loitering, fighting, or other factors, at the <br />discretion on the Planning Director, this conditional use permit may be submitted to the <br />Planning Commission for their subsequent review at a public hearing. If necessary, the <br />Planning Commission may modify or add conditions of approval to mitigate such <br />impacts, or may revoke said conditional use permit. <br />7. The kitchen shall remain open during the operating hours of the business with the <br />complete menu made available to restaurant patrons. <br />8. The business shall comply with the Chapter 9.24 of the Pleasanton Municipal Code <br />(Smoking in Public and Work Places). <br />
