PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. PC-2006-43 <br />RESOLUTION RECOMMENDING APPROVAL OF A NEGATIVE DECLARATION <br />FOR THE APPLICATION OF CHARLES AUSTIN AND SCOTT AUSTIN, <br />AS FILED UNDER CASE PUD-58/PGPA-1 I <br />WHEREAS, Charles Austin and Scott Austin have applied for General Plan Amendment to <br />change the land use designation of an approximately 30-acre hillside property <br />from Rural Density Residential (1 du/5 ac) to Low Density Residential (<2 du/ac) <br />land uses on approximately eight acres with a maximum density of eight units and <br />Agriculture and Grazing land uses on the remaining 22 acres; to rezone the <br />subject property from the A (Agriculture) District to PUD-LDR (Planned Unit <br />Development -Low Density Residential) and PUD-AG (Planned Unit <br />Development -Agriculture and Grazing) Districts; and for PUD development <br />plan approval to subdivide the subject property into eight custom home sites and <br />designate the remaining 22 acres for permanent open space, for the property <br />located at 3459 Old Foothill Road; and <br />WHEREAS, the Planning Commission received and reviewed the Initial Study, dated July 19, <br />2006 and received the recommendation of staff; and <br />WHEREAS, at its meeting of August 23, 2006, the Planning Commission received a proposed <br />Negative Declaration for Case PUD-58/GPA-11; and <br />WHEREAS, the public was given the opportunity to comment on the environmental impacts of <br />the proposal; and <br />WHEREAS, the Planning Commission has reviewed the potential impacts in accordance with <br />the applicable State and local guidelines governing the preparation of Negative <br />Declarations; and <br />WHEREAS, the Planning Commission finds that approval of the proposed project would not <br />have any significant adverse effects on the site's wildlife. <br />
