Tentative/Final Subdivision Map Requirements: <br />25. With the tentative subdivision map, the project developer shall set forth the common <br />open space/ maintenance areas of the proposed development and maintenance <br />responsibilities. The project developer shall record CC&R's at the time of recordation of <br />the final subdivision map, which shall create a property owners association for the <br />development. The CC&R's shall be subject to the review and approval of the City <br />Attorney prior to recordation of the final map. The property owners association shall be <br />responsible for the maintenance of all private utilities, and other common areas and <br />facilities on the site, including all landscaping and soundwalls extending to the Vineyard <br />Avenue face-of--curb. The City shall be granted the rights and remedies of the <br />association, but not the obligation, to enforce the maintenance responsibilities of the <br />property owners association. <br />26. The CC&R's for the project shall prohibit the pazking of boats, campers, and trailers on <br />site. <br />27. Prior to recordation of the final subdivision map, all modifications required to the design <br />guidelines thorough conditions of approval shall be combined into a single <br />comprehensive document. This document shall be submitted to the Planning Director for <br />review and approval prior to publication. The project developer or its successor in <br />interest shall disclose the design guidelines to the lot buyers prior to close of escrow, and <br />shall provide them with copies of the guidelines. <br />28. Any proposed phasing of this development shall be depicted on the tentative subdivision <br />map and shall include narrative explaining and proposed phasing. Unless a phasing plan <br />for improvements is approved by the Planning Director, the project developer shall <br />complete all of the on-site improvements at one time, including all improvements azound <br />future building pads. All remaining pad areas shall be planted with a hydroseed mixture <br />consisting of the following species and rate-of-cover: crimson clover (20.0 lbs/acre), <br />California poppy (3.0 lbs/acre), valley lupine (5.0 Ibs/acre), farewell-to-spring (2.0 <br />lbs/acre), and African daisy (2.0 lbs/acre). The hydroseed mixture shall be specified on <br />the improvement/landscape plans for review and approval by the Planning Director and <br />shall be maintained by the project developer until sold and then shall be maintained by <br />the lot owner. <br />29. The recorded deed of sale for all lots covered by this PUD Development Plan approval <br />shall include the following: <br />a. A clause which states that the property is in an area subject to noise, dust, and <br />vibration levels from gravel harvesting and processing and that the City of <br />Pleasanton is not liable for possible damages due to such impacts. <br />b. The recorded deed of sale shall include anoise/dusUvibration easement. <br />
