The proposed location of the conditional use and the conditions under <br />which it would be operated or maintained will not be detrimental to the <br />public health, safety, or welfare, or materially injurious to the properties or <br />improvements in the vicinity. <br />The proposed business is small in scale. Based on the proposal, its operation <br />would be compatible with other uses in the area as it would be confined inside the <br />building and has hours of operation. The noise and traffic generated from the <br />proposed use will not impact any residential uses. Additionally, adequate and <br />safe ingress and egress into and out of the site and sufficient on-site parking <br />would make the proposed use suitable for the subject site. Therefore, the second <br />finding can be made. <br />The proposed conditional use will comply with each of the applicable <br />provisions of the Zoning Ordinance. <br />The I-P zoning of the subject site allows the establishment of a warehouse <br />operation with a conditional use permit. As conditioned, the approval of the use <br />permit to operate the proposed food product and vending machine distribution <br />business with storage of materials as described would be consistent with the <br />City's ability to regulate zoning. As an approved site, the proposed location <br />complies with the parking, noise, setback, and other site development standards <br />required by the zoning ordinance for the I-P District. Therefore, the third finding <br />can be made. <br />WHEREAS, the Planning Commission determined that the proposed conditional use would be <br />compatible with the existing uses in the area. <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br />Section 1. Approves Case PCUP-151, the application of Mario Montalvo/Vision Food <br />Services for a conditional use permit to operate a food distribution service with <br />vending machine/food product warehousing in the existing building located at <br />5776 Sonoma Drive, Suite B, subject to the conditions shown in Exhibit B, <br />attached hereto and made part of this case by reference. <br />Section 2. This resolution shall become effective 15 days after its passage and adoption <br />unless appealed prior to that time. <br />
