EXHIBIT B <br />CONDITIONS OF APPROVAL <br />PCUP-164, Yu-Chin Chin, Young Ivy Academy <br />5460 Sunol Boulevard, Suites 3 and 4 <br />Apri126, 2006 <br />The location and operation of the proposed use shall conform substantially to <br />Exhibit A (the site plan, floor plans, and details of operation), dated "Received, <br />March 21, 2006", on file with the Planning Department, except as modified by the <br />following conditions of approval. Minor changes to the approved operation and <br />schedule may be approved by the Planning Director if found to be in substantial <br />compliance with the proposal. <br />2. Additional hours and activities beyond what was stated in the applicant's statement of <br />operation, dated "Received, March 21, 2006", on file in the Planning Department may <br />be approved by the Planning. The Planning Director may also refer the matter to the <br />Planning Commission if the proposed changes would be significant. <br />If operation of this use permit results in conflicts pertaining to parking, noise, <br />traffic/circulation, or other factors, at the discretion of the Planning Director, this <br />conditional use permit may be submitted to the Planning Commission for their <br />subsequent review at a public hearing. If necessary, the Planning Commission may <br />modify or add conditions of approval to mitigate such impacts, or may revoke the <br />said conditional use permit approval. <br />4. Prior to the opening of the after-school program, the applicant shall soundproof the <br />tenant space. The tenant improvement plan shall detail the soundproofing to the <br />common walls shared by the adjoining tenants. A building permit, if required, shall <br />be obtained prior to commencement of any work. <br />5. Prior to the opening of the after-school program, the applicant shall contact the Fire <br />Marshal to conform to Fire Code requirements, if applicable. <br />6. No changes to the exterior of the building shall be made without prior approval from <br />the Planning Department. <br />All signage shall conform to Oak Hills Shopping Center sign program. No large <br />lettering (of vinyl or other material) shall be placed on the windows. <br />8. The applicant shall obtain a City business license prior to the opening of the after- <br />school program. <br />9. This conditional use permit approval will lapse one (1) year from the effective date of <br />approval unless the applicant receives a business license. <br />(end} <br />
