EXHIBIT B CONDITIONS OF APPROVAL PCUP-164, Yu-Chin Chin, Young Ivy Academy 5460 Sunol Boulevard, Suites 3 and 4 Apri126, 2006 The location and operation of the proposed use shall conform substantially to Exhibit A (the site plan, floor plans, and details of operation), dated "Received, March 21, 2006", on file with the Planning Department, except as modified by the following conditions of approval. Minor changes to the approved operation and schedule may be approved by the Planning Director if found to be in substantial compliance with the proposal. 2. Additional hours and activities beyond what was stated in the applicant's statement of operation, dated "Received, March 21, 2006", on file in the Planning Department may be approved by the Planning. The Planning Director may also refer the matter to the Planning Commission if the proposed changes would be significant. If operation of this use permit results in conflicts pertaining to parking, noise, traffic/circulation, or other factors, at the discretion of the Planning Director, this conditional use permit may be submitted to the Planning Commission for their subsequent review at a public hearing. If necessary, the Planning Commission may modify or add conditions of approval to mitigate such impacts, or may revoke the said conditional use permit approval. 4. Prior to the opening of the after-school program, the applicant shall soundproof the tenant space. The tenant improvement plan shall detail the soundproofing to the common walls shared by the adjoining tenants. A building permit, if required, shall be obtained prior to commencement of any work. 5. Prior to the opening of the after-school program, the applicant shall contact the Fire Marshal to conform to Fire Code requirements, if applicable. 6. No changes to the exterior of the building shall be made without prior approval from the Planning Department. All signage shall conform to Oak Hills Shopping Center sign program. No large lettering (of vinyl or other material) shall be placed on the windows. 8. The applicant shall obtain a City business license prior to the opening of the after- school program. 9. This conditional use permit approval will lapse one (1) year from the effective date of approval unless the applicant receives a business license. (end}
