RESOLUTION NO. 07-150 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON, <br />APPROVING THE COST-SHARING AGREEMENT BETWEEN SURPLUS PROPERTY <br />AUTHORITY OF ALAMEDA COUNTY, THE CITY OF LIVERMORE AND THE CITY OF <br />PLEASANTON <br />WHEREAS, The City of Livermore has prepared a specific plan ("EI Charro Specific <br />Plan") to guide the future potential uses and development of approximately 250 acres just east <br />of EI Charro Road at the western edge of Livermore; and <br />WHEREAS, the Alameda County Surplus Property Authority is the owner of <br />approximately 124 acres of real property located in unincorporated County immediately to the <br />east of Pleasanton commonly known as Staples Ranch ("Staples Ranch Property"). The <br />Staples Ranch Property is located within Pleasanton's sphere of influence, and it is anticipated <br />that PLEASANTON will annex the Staples Ranch Property promptly following approval of the <br />Staples Ranch Project, as defined below; and <br />WHEREAS, Pleasanton is preparing an amendment to the Stoneridge Drive Specific <br />Plan to guide future development of the Staples Ranch Property ("Staples Ranch Specific <br />Plan°); and <br />WHEREAS, On May 16, 2006, Livermore issued a Notice of Preparation, with respect to <br />a Draft Environmental Impact Report ("EIR") for the EI Charro Specific Plan. On January 11, <br />2007, Livermore released the Draft EIR for the EI Charro Specific Plan for public review and <br />comment. On April 13, 2007, Livermore distributed the Final EIR. On July 9, 2007, the <br />Livermore City Council certified the Final EIR for the EI Charro Specific Plan ("Livermore EIR"). <br />WHEREAS, Authority has proposed amixed-use development project on the Staples <br />Ranch Property as described in the Notice of Preparation for the Stoneridge Drive Specific Plan <br />Amendment/Staples Ranch DEIR, dated March 19, 2007 and prepared by Pleasanton, ("Staples <br />Ranch Project"). The Staples Ranch Project includes an auto mall site encompassing 37 acres, <br />a 45t acre senior continuing care community for up to 800 units plus supporting skilled nursing <br />facilities comprising approximately 1,400,000 square feet, a 17t acre community park, which <br />may include lighted sports fields and afour-rink ice-skating facility, and future commercial uses <br />on the remaining 16 acres. The Authority and Pleasanton have entered into a Memorandum of <br />Understanding dated April 18, 2006, ("Staples Ranch MOU"), regarding the processing of <br />applications and consideration of entitlements required for the Staples Ranch Project, and it is <br />anticipated that Pleasanton will consider certifying an EIR for the Staples Ranch Project in 2008. <br />WHEREAS, both the EI Charro Specific Plan and the Staples Ranch Project require <br />improvements to EI Charro Road prior to occupancy of new developments, and Authority and <br />Livermore, together with the County of Alameda ("the Count'), Pleasanton and Vulcan <br />Materials, have negotiated and are executing the Pre-Development Cooperation Agreement that <br />specifies the level and timing of construction of the EI Charro Road Improvements. <br />WHEREAS, the Livermore EIR indicates that a portion of the EI Charro Specific Plan is <br />currently within the 100-year flood zone, and that a portion of the Staples Ranch Property is also <br />within the 100-year flood zone. As described in the Livermore EIR, flood water passes through <br />the EI Charro Specific Plan and then crosses EI Charro Road just south of Interstate 580.
