CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 87-462 <br /> <br /> RESOLUTION AUTHORIZING SETTLEMENT OF CONDEMNATION ACTION <br /> AGAINST VICTOR L. LUND, JR., ET AL. REGARDING SYCAMORE <br /> RESERVOIR SITE <br /> <br /> WHEREAS, at its meeting of October 6, 1987, Council reviewed the <br /> proposed settlement of the eminent domain proceeding <br /> against Victor L. Lund, Jr., et al. regarding the <br /> Sycamore Water Reservoir site; <br /> <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> RESOLVES AS FOLLOWS: <br /> <br /> Section 1: Authorizes settlement of condemnation action of City <br /> vs. Victor Lund, et al., Action No. H126261-8, on the <br /> following terms: <br /> <br /> 1. City shall pay the owners of the subject property <br /> $271,700 for the 2.47 acre reservoir site. <br /> <br /> 2. City shall pay $26,300 for the temporary <br /> construction easement and drain line easement· <br /> <br /> Section 2: Authorizes the Mayor to execute all documents <br /> necessary to implement the above settlement. <br /> <br /> Section 3: Accepts a deed for the subject property and the <br /> appropriate City officers are instructed to take <br /> whatever action necessary to implement said acceptance. <br /> <br /> Section 4: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br /> THIS RESOLUTION ADOPTED OCTOBER 6, 1987 BY THE FOLLOWING VOTE: <br /> <br /> AYES: Councilmembers - Brandes, Butler, Mohr, Wilson and Mayor <br /> Mercer <br /> NOES: None <br /> ABSENT: None <br /> ABSTAIN: None NN~ETH~ <br /> ATTEST: ~ <br /> · MERCER, MAYOR <br />~ Doris George, Deputy City C].erk <br /> <br /> Pet~e~ ' D ."
