CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 87-461 <br /> <br /> RESOLUTION AUTHORIZING SETTLEMENT OF CONDEMNATION ACTION <br /> AGAINST MICHAEL F. HARRIS, ET AL. REGARDING SYCAMORE <br /> RESERVOIR SITE <br /> <br />WHEREAS, at its meeting of October 6, 1987, Council reviewed the <br /> proposed settlement of the eminent domain proceeding <br /> against Michael F. Harris, et al. regarding the Sycamore <br /> Water Reservoir site; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: Authorizes settlement of the condemnation action of <br /> City vs. Michael F. Harris, et al., Action No. <br /> H126981-3, on the following terms: <br /> <br /> 1. the City shall pay Mr. Harris and C. F. Humphreys <br /> $73,000 for public utility, access, box culvert, <br /> and pipeline easements; <br /> <br /> 2. City shall grant Mr. Harris permission to obtain <br /> City water without annexing to the City because <br /> Harris does not have potable well water; <br /> <br /> 3. Mr. Harris agrees to pay for all costs of obtaining <br /> City water; and <br /> <br /> 4. Mr. Harris shall submit appropriate engineering <br /> details for City Engineer's approval of water line. <br /> <br />Section 2: Authorizes the Mayor to execute all documents <br /> necessary to implement the above settlement. <br /> <br />Section 3: Accepts a deed for the subject property and the <br /> appropriate City officers are instructed to take <br /> whatever action necessary to implement said acceptance. <br /> <br />Section 4: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br /> <br />
