CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 87-457 <br /> <br /> RESOLUTION APPROVING THE APPEAL OF THE CITY COUNCIL TO A <br /> DECISION OF THE DESIGN REVIEW BOARD DENYING THE <br /> APPLICATION OF WELLINGTON HOMEOWNERS ASSOCIATION FOR <br /> DESIGN REVIEW APPROVAL TO INSTALL PERMANENT GATES ACROSS <br /> THE EASTERN DRIVEWAY ENTRANCE OF THE WELLINGTON <br /> TOWNHOUSE COMPLEX LOCATED AT 5375 BLACK AVENUE <br /> (AP-87-17) <br /> <br /> WHEREAS, at its meeting of September 9, 1987, the Design Review <br /> Board denied the application of Wellington Homeowners <br /> Association (Z-87-391) for design review approval to <br /> install permanent gates across the eastern driveway <br /> entrance of the Wellington Townhouse complex located at <br /> 5375 Black Avenue; and <br /> <br /> WHEREAS, this decision was appealed by the City Council; and <br /> <br /> WHEREAS, a public hearing was held before the City Council on <br /> October 6, 1987 at which time all pertinent testimony <br /> and documents were reviewed; <br /> <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> RESOLVES AS FOLLOWS: <br /> <br /> Section 1: Approves the appeal of a decision of the Design <br /> Review Board and grants design approval to install <br /> permanent gates across the eastern driveway entrance of <br /> the Wellington townhouse complex located at 5375 Black <br /> Avenue, subject to the condition that the gates are to <br /> be kept clear at all times for emergency vehicle access. <br /> <br /> Section 2: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br /> THIS RESOLUTION ADOPTED OCTOBER 6 1987 BY THE FOLLOWING VOTE: <br /> <br /> AYES: Councilmembers - Brandes, Mohr, Wilson and Mayor Mercer <br /> NOES: Councilmember Butler <br /> ABSENT: None <br /> ABSTAIN: None ~~ <br /> ATTEST: <br /> K~NNETH R.
