PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. PC-88-74 <br />RESOLUTION RECOMMENDING APPROVAL OF CASE PUD-83-12-5M, <br />APPLICATION OF BAS HOMES, INC. <br />WHEREAS, Bas Homes has applied for a major modification to an <br />approved development plan for an existing residential <br />project to allow 6 foot fences to be constructed within <br />7 feet of the property line of the street side of corner <br />lots located on lots 7, 11, 14, 15, and 19 of Tract 5445 <br />on Martin Avenue; and <br />WHEREAS, zoning for the property is PUD (Planned Unit <br />Development) - Low Density Residential District; and <br />WHEREAS, at their duly noticed public hearing of June 22, 1988, <br />the Planning Commission considered all public testimony, <br />relevant exhibits and recommendations of the City staff <br />concerning this application; and <br />WHEREAS, projects of this nature are categorically exempt from <br />the requirements of the California Environmental Quality <br />Act (CEQA). <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br />Section 1. Recommends approval of Case PUD-83-12-5M, application <br />of bas Homes for a major modification to an approved <br />development plan for an existing residential project to <br />allow 6 foot fences to be constructed within 7 feet of <br />the property line on the street side of corner lots <br />located on lots 7, 11, 14, 15, and 19 of Tract 5445 on <br />Martin Avenue subject to the following conditions: <br />1. That fences not exceeding 6 feet in height may be <br />constructed to within 7 feet of the street side <br />property line on Lots 7, 11, 14, 15, and 19 of <br />Tract 5445 (as shown in the site plans, Exhibit A, <br />dated May 9, 1988, on file with the Planning <br />department) upon approval by the Planning Director <br />of the fence design and a landscape plan for the <br />street side yard. In addition, the owner shall <br />enter into a landscape maintenance agreement with <br />the City to ensure maintenance of the side yard <br />landscaping. <br />2. That except as modified by Condition 1 above, all <br />conditions of Cases PUD-83-12 through PUD-83-12-4M <br />shall remain in full force and effect. <br />Section 2. This resolution shall become effective immediately <br />upon its passage and adoption. <br />
