5. Exterior finishes for the 20 affordable units, including materials and landscaping, shall be <br />consistent with the market rate units in the associated project. Interior amenities <br />including appliances, carpeting, electrical and plumbing fixtures, hardware and <br />countertops, etc., for the affordable units shall be of high quality as specified and <br />approved by the City, provided that the City shall not require specification levels that <br />exceed those of the market rate units. <br />6. Developer shall be exempt from payment of the Lower Income Housing Fee for the 51 <br />units in the Oak Grove project. However, in the event that Developer has not pulled <br />building permits for the 20 affordable units within five years from the approval of the <br />first final map for the Project, the opportunity to build the units on another property or <br />properties shall expire and the Developer shall pay the Lower Income Housing Fee for <br />a1151 units at the amount then in effect. <br />7. Developer shall provide to the City's Housing Division by January 1 of each year an <br />annual progress report on the status of development of the 20 affordable units until such <br />time as the units are under construction or the opportunity to build the units off site has <br />expired. <br />8. The affordable units shall be made available to eligible households for rent and/or for sale <br />subject to the City's adopted preference system for affordable housing projects then in <br />effect. <br />[SIGNATURE PAGE FOLLOWS] <br />
