EXHIBIT J-7 <br />PUD-33, James Tong/Charter Properties; Jennifer Lin, Frederic Lin, and Kevin Lin <br />Consideration of: (1) the Final Environmental Impact Report for the Oak Grove <br />development; (2) an application for a PUD development plan for the Oak Grove <br />development to subdivide an approximately 562-acre site into 51 custom home sites and to <br />designate the remaining area for permanent open space; and (3) the Development <br />Agreement to vest the entitlements covered by this application. The property is located at <br />1400 Hearst Drive, near the present terminus of Hearst Drive on the southerly sides of the <br />Vintage Hills and the Grey Eagle Estates developments and is zoned PUD - RDR/OS <br />(Planned Unit Development -Rural Density ResidentiaVOpen Space) District. <br />Ms. Decker advised that the Planning Commission's task would be to listen to the presentations <br />by staff and the applicant, take public testimony, and provide a recommendation to City Council <br />with regard to the Final Environmental Impact Report (EIR) of the proposed PUD development <br />plan, which is the environmentally preferred 51-unit plan, and the development agreement. All <br />the agreements, text, and existing visuals were provided to the Commissioners. The Planning <br />Commission's charge during this hearing would be to determine whether the Final EIR can be <br />certified, meaning that the process of hearing and reviewing the presentations on the Draft EIR <br />had taken place. The responses to comments essentially comprise the Final EIR. The Planning <br />Commission would evaluate whether or not those responses were appropriate and adequate, and, <br />therefore, a recommendation could be made on whether the Final EIR may be certified. <br />Ms. Decker then introduced Marion Pavan, Associate Planner and project planner. <br />Mr. Pavan stated that at the close of a three-year process, he had considered it a distinct privilege <br />to be able to work on this project. He presented the staff report and noted that Commissioner <br />Narum, because of her previous service on the Parks and Recreation Commission, would not be <br />able to speak on the open space issues but may speak and provide recommendation on the <br />project. He then detailed the background, scope, and layout of the proposed project. He noted <br />that with respect to phasing, two thresholds existed: <br />1. Phasing with respect to when fire measures need to be installed, including a water tank. <br />Some lots may be constructed, absent the fire access road, the EVA, or water tank. <br />2. Before that phase may take place, there is also a threshold with respect to the installation <br />of trails and open space, which must be done before the sale of the fifth lot. <br />In response to an inquiry by Chairperson Fox with respect to Commissioner Narum's presence <br />on the dais during the discussion of open space during the staff report, Mr. Roush confirmed that <br />while she may not be able to participate in the discussion concerning open space, for purposes of <br />presentation of the staff report, she may remain to hear that section of the staff report. <br />Mr. Pavan continued to describe the EIR process for this project, described the open space area, <br />and displayed the trail plan on the overhead screen. <br />Commissioner O'Connor stated that it seemed like the language of the conditions of approval <br />with respect to completing the road in the phasing was not clear.
