DVD views of the proposed project prepared by the applicant. <br />I. BACKGROUND <br />Site History <br />The Lin property was annexed into the City on December 31, 1991. The site of the Oak <br />Grove development was part of a much larger property purchased by the Lin family in <br />1977, which included the site of the adjoining Kottinger Ranch development. The <br />property is currently used as range land to free-graze livestock. The Lin family <br />constructed two stock ponds on the site to provide water for livestock. The City's <br />Kottinger water tank is located in the southwest quadrant and is accessed from <br />Benedict Court via an access and maintenance easement granted to the City. <br />In October 16, 1984, The City Council approved GP-84-7 and PUD 84-5, which included <br />the Kottinger Ranch development consisting of 156 single-family homes and permanent <br />open space area. The open space area corresponded to areas of creeks, swales, and <br />hillsides. To achieve the open space preservation, the Kottinger Ranch streets and <br />homes were located on the flat and ridge portions of the site. Kottinger Ranch was <br />anticipated and planned as the first phase of development of the entire Line property in <br />that the Lin property was rezoned to position the property for development. <br />In October 20, 1992, the City Council approved PUD-91-13, "Kottinger Hills," which <br />proposed 86 single-family detached "production" homes in a conventional subdivision <br />format, an 18-hole golf course, and approximately 237 acres of open space proposed <br />for dedication to the City. The Council's action was overturned in a referendum election <br />held on November 2, 1993. <br />Proposal <br />The property owners Jennifer, Frederic, and Kevin Lin, have submitted an application <br />(PUD-33) for a Planned Unit Development (PUD) Plan. The first submittal to the City <br />was as a 98-lot custom home development with afive-acre neighborhood park, and a <br />new water tank as referenced in the Draft Environmental Impact Report (DEIR) as AH- <br />1. The remaining open space area would have been an open offer of dedication to the <br />City. Public trails and a staging area were proposed to be built by the City after the <br />City's acceptance of the open space as City land. Staff determined that there would be <br />several environmental concerns and, therefore, required an Environmental Impact <br />Report (EIR) be prepared to identify which impacts would be significant enough <br />requiring either mitigations or possible statements of overriding consideration. <br />PUD-33 Page 3 of 59 June 13, 2007 <br />
