Exhibit B-4 <br />Draft Environmental Findings and <br />Statement of Overriding Considerations <br />PUD-33, Oak Grove Development/Lin Property <br />September 4, 2007 <br />1. INTRODUCTION <br />The Oak Grove Planned Unit Development -PUD-33 - is a development on a 562-acre <br />site located in southeast Pleasanton including 51 custom homes, a permanent open <br />space component with local and regional trails and a staging area, and ancillary public <br />improvements including public streets, stormwater treatment facilities, a municipal water <br />tank, etc. The City of Pleasanton is the lead agency under the California Environmental <br />Quality Act (CEQA) and has prepared an environmental impact report (EIR) for this <br />project. <br />Section 15091 of California Code of Regulations, Title 14, Chapter 3 (CEQA Guidelines) <br />and Section 21081 of the Public Resources Code requires the lead agency to adopt <br />findings for each potentially significant environmental impact disclosed in an EIR. <br />Specifically, for each significant impact, the lead agency must make one or more of the <br />following three findings: <br />^ Changes or alterations have been incorporated into the project to avoid or <br />substantially lessen the significant environmental effects identified in the EIR; <br />Such changes or alterations are within the responsibility and jurisdiction of <br />another public agency and should be adopted by that agency; or <br />^ Specific economic, social, legal, technological, or other considerations make the <br />mitigation measures or alternatives identified in the EIR infeasible. <br />In addition to making a finding for each potentially significant impact, if the lead agency <br />approves a project without mitigating all of the significant impacts, it must prepare a <br />statement of overriding considerations, in which it balances the benefits of the project <br />against the unavoidable environmental risks. The statement of overriding <br />considerations must explain the social, economic, or other reasons for approving the <br />project despite its environmental impacts (CEQA Guidelines § 15093, Public Resources <br />Code § 21081). <br />This document contains the findings and statement of overriding considerations for the <br />approval of the Oak Grove Planned Unit Development project and reflects the City of <br />Pleasanton's independent judgment. <br />This document incorporates by reference the Oak Grove Planned Unit Development <br />EIR.
