EXHIBIT B-4 RESOLUTION NO. 07- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON, ADOPTING THE CEQA FINDINGS AND THE STATEMENT OF OVERRIDING CONSIDERATIONS FOR THE OAK GROVE PLANNED UNIT DEVELOPMENT, AS FILED UNDER CASE PUD-33 WHEREAS, the City of Pleasanton, acting as lead agency under the California Environmental Quality Act (CEQA), prepared a Draft Environmental Impact Report for the proposed project which was published on June 30, 2006 and provided proper legal notice of document preparation and availability; and WHEREAS, the Planning Commission held noticed public hearings on June 13, 2007 and June 27, 2007 to accept oral comments on the Draft Environmental Impact Report during the forty-five-day public review period, and the City also accepted and responded to written comments to the Draft Environmental Impact Report received from public agencies having jurisdiction by law, persons having special expertise with respect to any environmental impact involved, and other persons or organizations having an interest in the proposed project; and WHEREAS, the Final Environmental Impact Report has been prepared and contains the Draft Environmental Impact Report, comments and recommendations received on the Draft Environmental Impact Report, and the responses of the City of Pleasanton to significant environmental points raised in the review and consultation process; and WHEREAS, the City provided proper notice of completion of the Final Environmental Impact Report; and WHEREAS, on September 4, 2007, the City Council certified the Final Environmental Impact Report for the project as adequate and complete. NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES RESOLVE, DECLARE, DETERMINE, AND ORDER THE FOLLOWING: SECTION 1. Adopts the CEQA Findings and Statement of Overriding Considerations prepared for the project, attached hereto as Exhibit C. SECTION 2. This resolution shall become effective immediately upon its passage and adoption. PASSED, APPROVED, AND ADOPTED by the City Council of the City of Pleasanton at a regular meeting held on September 4, 2007.
