the fence plan in consultation with the USFWS and shall submit the plan to the City of <br />Pleasanton and the USFWS for review and approval prior to the City's action on the first <br />Final Subdivision Map. The fencing shall be installed 10 days before grading begins <br />and shall be maintained during all grading activities. <br />(ii) Remaining Impacts. <br />Any remaining impacts related to impacts to Alameda whipsnake and its habitat will be <br />less than significant. <br />Impact on Any Riparian Habitat or Other Sensitive Community <br />7. Impact on Wetlands and Waters of the United States and/or the State of <br />California (DEIR, pp. 108-110, 119-120 and 359/360; Condition 9e of PUD-33; MMIP <br />D8). <br />a. Potentiallmpact. <br />The Original Project's potential impacts due to proposed filling of 2,004 square feet of <br />Section 404 and isolated wetlands and 2,708 linear feet of waters of the U.S. and <br />California in drainages are discussed in the DEIR at page 108-110. The <br />Environmentally Superior Project would reduce these impacts to the proposed filling of <br />1,171 square feet of Section 404 and isolated wetlands and 145 linear feet of waters of <br />the U.S. and California in drainages. These impacts are discussed in the DEIR at page <br />359. <br />b. Mitigation Measures. <br />The following mitigation measure is hereby adopted and will be implemented as <br />provided for in the Mitigation Monitoring and Implementation Program: <br />• Implement Oak Grove Planned Unit Development (PUD-33) Mitigation Measure <br />D8. <br />c. Findings. <br />Based on the EIR and the entire record before the City, the City finds that: <br />(i) Effects of Mitigation. <br />To mitigate the potential significant impact on United States wetlands and waters from <br />the proposed filling of Section 404 and isolated wetlands and drainages associated with <br />the Environmentally Superior Project, the project developer shall mitigate the impacts by <br />creating on-site wetlands at a 2:1 ratio, and new drainages on-site at a 1:1 ratio or shall <br />preserve off-site drainages at a 10:1 ratio. <br />Page 20 of 43 <br />
