Hydrology and Water Quality <br />71. To mitigate the creation of new impervious surfaces that would increase the <br />amount and/or the intensity of runoff, potentially exacerbating existing <br />downstream flooding problems and/or causing hydro modification impacts, the <br />project developer (for the infrastructure) and/or lot owner/contractor (for the <br />individual lots) shall pay the applicable regional drainage fees to the Alameda <br />Water Quality and Flood Control District, Zone 7, at the final map for impervious <br />road surfaces (project developer) and with each building permit for lot <br />development (lot owner/contractor). (Mitigation Measure H-1-b of the FEIR.) <br />Open Space Area <br />72. The property owner shall dedicate in fee title to the City of Pleasanton or to <br />another public entity selected by the City the open space area surrounding Lots 1 <br />through 51 with recordation of the first final subdivision map. The open space <br />area shall be subject to an open space/conservation easement granted to the Tri- <br />Valley Conservancy or other organization authorized to hold open <br />space/conservation easements, and shall be in accordance with the <br />requirements of the Development Agreement. <br />73. Before the sale of the fifth lot, the project developer shall install local and regional <br />public trails in the open space area generally following the alignments shown in <br />Exhibit I, dated March 2007 in accordance with the requirements of the <br />Development Agreement. The location of the trails shall be subject to the review <br />and approval of the Parks and Recreation Commission and Trails Ad-Hoc <br />Committee. The trails' locations shall avoid the environmentally sensitive areas <br />designated on the approved mitigation monitoring plans. <br />74. Before the sale of the fifth lot, the project developer shall install a public trail <br />staging area in the open space area, generally located in the area by the <br />proposed City water tank, in accordance with the requirements of the <br />Development Agreement. The design and operation of the staging area shall <br />include measures to secure the area from sundown to sunrise. The design, <br />operation, and location of the trail staging area shall be subject to the review and <br />approval of the Parks and Recreation Commission and Trails Ad-Hoc Committee. <br />Phasing <br />75. The project shall be allowed to be phased by the processing of phased final <br />maps. Any proposed phasing of this development shall be depicted on the <br />tentative subdivision map and shall include narrative explaining the proposed <br />phasing. Unless a phasing plan for improvements is approved by the Planning <br />Director and the City Engineer, the project developer shall complete all of the on- <br />site improvements at one time. The project developer shall submit improvement <br />plans clearly depicting proposed phasing for review and approval by the City <br />Page 28 of 37 <br />
