10. To meet the Mitigation Monitoring and Implementation Measures D-4 and D-5 of <br />the FEIR, the project developer shall perform the following: <br />• If grading is scheduled to begin during raptor breeding season as defined by <br />the California Department of Fish and Game, a qualified biologist shall <br />conduct apre-construction survey 30 days prior to the beginning of grading to <br />verify the presence/absence of active raptor nests. The project developer <br />shall implement the discussion points stated in the Oak Grove Draft <br />Environmental Impact Report. <br />• The project developer shall retain a qualified biologist to conduct apre- <br />construction survey 30 days prior to the beginning of site grading to verify the <br />presence or absence of burrowing owl nesting sites. The project developer <br />shall implement the discussion points stated in the Oak Grove Draft <br />Environmental Impact Report. <br />Construction shall not take place if it is determined by the biologists that such <br />construction would disturb an identified active raptor nest and/or burrowing owl <br />nest or burrow. These statements shall be added to all site plans, grading plans, <br />and/or improvement plans covering this development and/or the individual <br />building sites. These same requirements shall apply to the individual home <br />building sites and shall be added to the design guidelines covering this <br />development. <br />Homeowners Association and Geologic Hazard Abatement District <br />11. A Homeowners Association (HOA) and/or a Geologic Hazard Abatement District <br />(GRAD) shall be responsible for the maintenance of the wildland fire and buffer <br />areas on designated sections of the open space area, bio-detention ponds, <br />landscape buffer and tree reforestation areas on the north and west sides of the <br />development. The HOA and/or GRAD responsibilities shall be determined with <br />the first final subdivision map and shall be carried through to all subsequent final <br />map approvals. The HOA's maintenance responsibilities shall be described in <br />the CC&R's. <br />12. The open space area may be dedicated to the GRAD, in which the Pleasanton <br />City Council is the Board of Directors, in lieu of the City. If that occurs, in addition <br />to the above responsibilities, the GRAD shall be also be responsible for the <br />grazing management plan and the mitigation and monitoring plan for the open <br />space area. <br />CC&R and Disclosure Requirements <br />13. The project developer shall record CC&R's at the time of recordation of the final <br />subdivision map, which shall create a Homeowners Association for the <br />development. The CC&R's shall be subject to the review and approval of the <br />City Attorney prior to recordation of the final map. <br />Page 4 of 37 <br />
