Housing Agreement incorporates the recommendations of the Housing Commission and <br />is reflected in the Development Agreement. <br />Development Agreement <br />The Development Agreement is a contract that allows the developer and the City to <br />establish the rules and procedures that will govern the property's development. <br />Exhibit A, which contains the elements of the project, is referred to and contained within <br />the Development Agreement, ensuring that it is constructed as reviewed and approved <br />by the decision-making bodies. The PUD development conditions of approval, <br />Exhibit C, will be added to the Development Agreement as an exhibit. If there are <br />conflicts between the terms of the Development Agreement and the PUD conditions, the <br />Development Agreement takes precedence. <br />VI. DISCUSSION <br />Please refer to the attached Planning Commission staff reports for a detailed discussion <br />and analysis of the proposed development. The following discussion focuses mainly on <br />those issues not resolved at the Planning Commission level, leading to the project's <br />denial. <br />Open Space/Trails <br />Figure 3, on the following page, shows the relationship of Oak Grove with its trails and <br />trail staging area to the Callippe Preserve Golf Course and Vineyard Avenue Specific <br />Plan area developments. <br />The Oak Grove development contributes to the City's goals of establishing a <br />permanent, continuous system of public open space and trails in southeast Pleasanton. <br />The City began implementing this goal with the Callippe Preserve Golf Course and <br />Vineyard Avenue Corridor Specific Plans. The City's goals with respect to this project <br />include the following: <br />• Preserve open space in perpetuity to transition from developed areas to <br />unincorporated agricultural areas; <br />• Protect and preserve continuous habitat areas and habitat corridors between <br />developments; and, <br />• Provide a continuous system of local and regional trails and trail staging areas <br />that link Pleasanton to the East Bay Regional Park District's regional trail system <br />on Pleasanton Ridge between Sunol and Dublin. <br />The Oak Grove development: <br />Dedicates approximately 496 acres of open space as publicly-owned open <br />space in perpetuity; <br />• Constructs a system of local and regional public trails and a public staging area <br />in the open space area early-on in the development's construction; and, <br />Page 10 of 27 <br />
